If you are an individual, "You" means your person and any person who works with you or helps you. If you work for an entity or you own it, the pronoun "You" means “the entity that agrees to authorize you to represent it as well as all other people who own or work for that entity, or preform work in favor of it. "Your" means the things that belong to you or are related to you.

SAMAYA HOTELS or (we) means SAMAYA HOTELS which its main business headquarters are in the United Arab Emirates - the Emirate of DUBAI. These terms also include any other entities that are affiliated with or controlled by SAMAYA HOTELS, or that it owns or it is controlled by the owner of SAMAYA HOTELS. Whenever this definition applies to any obligation, you must protect, pay or compensate the SAMAYA HOTELS for any damages or losses, (our) means the things that belong to or are related to the hotel. (Service) or (Services) mean, individually and collectively, "Applications" and any application or Program or services or Web sites or other related services, which we provide or provided by any third party appointed by us. And we pursue the Terms and Conditions as follows: -

1. Your use of SAMAYA HOTELS application services is subject to these conditions, and you can contact us through the help list in the application by using this service. You can log in it and download the application of content and available programs in the application ("the content") according to our services provided in the application.

2- Acceptance of terms and conditions

2.1. In order to use the services, you must first agree to the conditions and you may not use the services if you do not agree to the conditions, therefore your use of the service constitutes acceptance of these terms.

3- Registration

3.1 In order to access the services, you may be required to provide information about yourself as part of the registration procedures for the services or as part of your continued use of the services. 3.3 In the event that you are required to pay service fees, you will be able to choose options for credit card settings when you submit your registration data or when you make a transaction on the “content” application (by providing your credit card details at that point). Your credit card and bills information are stored, managed, and maintained by credit card companies or our payment portal provider. Their privacy policy applies to your credit card information and other personal details that have been provided to them. It is your sole responsibility and SAMAYA HOTELS has no responsibility about it.

4- Privacy policy

SAMAYA HOTELS respects your privacy. In order to make the services available to you and to process the transactions you carry out, SAMAYA HOTELS may obtain personal information and / or data from you and use this information and data in accordance with our privacy policy.
SAMAYA HOTELS may update the privacy policy from time to time, so please review the privacy policy periodically.

5- Contracts and Agreements Policy

5.1. You may have the right to contract and agree on all the services provided by SAMAYA HOTELS. whether they are services (renting or selling residential or commercial units - or renting or selling hotel apartments) or booking Units to be sold whether they are owned or other services Others that you provide, according to the applicable terms, conditions and laws in the country.

5.2. It may be necessary to carry out all or some of the transactions through the application of SAMAYA HOTELS, including unit reservation applications for purchasing, or purchasing procedures and contracts execution, and registration procedures in Dubai Land Department, contracts, documentation of contracts and other services provided by SAMAYA HOTELS.

In addition to paying all fees, amounts, payments, insurance, etc. via the application whenever possible. Except for Escrow accounts with Dubai Land Department. Otherwise, the payment method will be changed, and the selection of another payment method that suits the customer if desired.
5.3. In case of wanting to change the payment information of the customer which registered in the application, the customer can do so by entering the application section of … or contacting us in the help section in the application.

6-Content License

6.1 Contents available to you through the services are licensed by the competent authorities and the license for every content you obtain through the service is subject to the applicable End-User Licensing Agreement (EULA) or other applicable end user conditions of use. All rights not expressly granted to you are reserved.

7-System requirements

Use of the service requires a system that is consistent with the services, and may require a device such as a desktop computer, laptop, smartphone, tablet, or access to the Internet including getting updates or upgrades from time to time. Since the use of the services may involve equipment, software and access to the Internet, your ability to use the services may be affected by the performance of these factors. High-speed internet connection is highly recommended. You shall acknowledge and agree that you bear sole responsibility, and not others, regarding these system requirements, which may change from time to time.

8- Intellectual property rights

8.1 SAMAYA HOTELS reserves all rights, property rights and interest in and towards services including all related intellectual property rights, whether registered or not, and whenever these rights exist in the United Arab Emirates.

8.2 Nothing in these terms entitles you to the right to use any of the trade names, trademarks, service marks, logos, domain names and other distinctive brand benefits of SAMAYA HOTELS.

8.3 You agree not to remove, withhold, or modify any intellectual property rights notices (including copyright and trademark notes) that may be proved or contained in the services or content.

9- Termination

9.1 These conditions remain in force until terminated by you or by the SAMAYA HOTELS in accordance with the terms of this agreement and according to the period of your use of the application as long as the relationship with SAMAYA HOTELS is still valid and this relationship ends with the termination of your relationship with SAMAYA HOTELS and the termination of the purpose prepared for it, whether it is a rental relationship or sale or other services provided by SAMAYA HOTELS.

9.2 If you want to terminate your account, please inform us through the list in the application, or in the manner determined by SAMAYA HOTELS, or by the termination of the service for which you registered in the application. SAMAYA HOTELS terminates your account upon receiving notification of your desire to do so, provided that you shall pay all amounts due related to your account and when you terminate your account, all data and information associated with your account may be permanently deleted. SAMAYA HOTELS does not bear any responsibility towards this deletion that arises from the termination of your account.

9.3 SAMAYA HOTELS may at any time and for any reason terminate your account or your use of the services by serving you a notice of termination to the email address you provided in your registration data. You are required to pay all remaining amounts due directly to your account upon termination.

10- Disclaimer and limitation of liability

Disclaimer: The services and contents are provided "as they are", "wherever they exist", "to the extent that they are available" and without guarantees of any kind. SAMAYA HOTELS or its licensors do not submit any acknowledgments, guarantees or warranties of any kind or nature, whether expressed or implied, regarding services not agreed upon in the contract and all terms and conditions prescribed by the laws of the United Arab Emirates.

11- Indemnity

SAMAYA HOTELS for managing private real estate, its licensors, all its officials, managers, agents and employees or its licensors, and any party acting on behalf of it, are indemnified and discharged from and against any and all third-party claims, procedures, obligations, losses, damages, provisions, costs and expenses , including any fees required by the service that arise from (1) any use of the services on your part or by a person you allow to use the services in a manner that does not comply with these conditions (2) any breach of these terms on your part or by any person you allow to use the services or (3) any violation of any laws, regulations, or rights of any other party on your part or by any person you allow to use the services.

12- Advertising

Some services are supported by advertising revenues, and ads and advertising may be displayed. By considering obtaining or using the services, you agree that the SAMAYA HOTELS may put an advertising on the services in accordance with their absolute discretion without any conditions.

13- Termination

13-1 These provisions and other policies referred to in this agreement constitute the entire legal agreement between you and SAMAYA HOTELS that regulates your use of the services, and must be approved in relation to the services provided by them.

13-2 You agree that if the SAMAYA HOTELS does not exercise or implement any of the rights or remedies set forth in the conditions or that of which the SAMAYA HOTELS has under law and absolute justice rules, this omission is not considered as a waiver of any and all of these rights and remedies, and that these rights and remedies remain available to SAMAYA HOTELS.

13.3 If any provision of these conditions is declared invalid by any court of law with jurisdiction, then this provision shall be removed from the conditions without affecting the rest of the conditions. The remaining provisions in these conditions remain valid and enforceable.

13.4 You are not allowed to transfer, assign, impose, or otherwise dispose of these terms or any of your rights or obligations under these terms. SAMAYA HOTELS may transfer, assign, impose, or sub-contract or otherwise dispose of these conditions or any of their rights or obligations that arise under these terms at any time.

13.5 Governing law These terms and your relationship with SAMAYA HOTELS are subject to these laws of the United Arab Emirates.
